Acceptance of Terms

By accessing or using Virginia ("the Service"), you agree to be bound by these Terms of Use and our Privacy Policy. Virginia is operated by RAD Medical, LLC ("RAD Medical," "we," or "our"), a Massachusetts limited liability company. If you do not agree, you may not use the Service.

No Medical Advice

Virginia is NOT a medical device, medical advice, or a replacement for professional medical care.

  • Virginia is a digital tool designed to help you prepare for medical visits by organizing your questions and notes.
  • Virginia is not a medical device and is not regulated by the U.S. Food and Drug Administration (FDA).
  • Virginia does not diagnose, treat, cure, or prevent any disease or medical condition.
  • Virginia does not provide medical advice or create a physician–patient relationship.
  • Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment.
  • In an emergency, call 911 or your local emergency number.

Permitted Uses

You may use Virginia to:

  • Prepare for medical appointments
  • Organize your thoughts, concerns, and questions
  • Create notes or checklists to share with your healthcare provider

Prohibited Uses

You may not use Virginia to:

  • Seek or substitute medical diagnosis or treatment
  • Replace professional medical advice
  • Enter sensitive personal or protected health information (PHI)
  • Engage in illegal, harmful, or fraudulent activity
  • Attempt to copy, reverse engineer, modify, or interfere with the Service
  • Use automated tools (bots, scrapers) to access or extract data from the Service

User Responsibilities

By using Virginia, you agree to:

  • Use the Service responsibly and only for its intended purpose
  • Ensure any notes or information you choose to share with your provider are accurate and appropriate
  • Seek medical care when needed and not rely on Virginia for medical decisions
  • Comply with applicable laws in your jurisdiction
  • Notify us of any technical or security concerns through the feedback form

Service Availability & Termination

  • We strive to keep Virginia available continuously but cannot guarantee uninterrupted access.
  • The Service may be suspended or discontinued at any time without notice, including for maintenance, technical issues, or misuse.
  • We may terminate or restrict your access if you violate these Terms.

Disclaimer of Warranties

  • Virginia is provided "as is" and "as available."
  • We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not warrant that the Service will be error-free, secure, or uninterrupted.
  • Your use of Virginia is at your own risk.

Limitation of Liability

To the maximum extent permitted by law:

  • RAD Medical, LLC is not liable for any direct, indirect, incidental, consequential, or special damages, including medical decisions made in reliance on Virginia.
  • Our total liability to you for any claim related to the Service is limited to the greater of (a) the amount you paid to use the Service in the past 12 months (if any), or (b) $100.

Age Restrictions

Virginia is intended for use by individuals 13 years or older. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian. The Service is not directed to children under 13.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Boston, Massachusetts.

Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting, as reflected by the "Last updated" date above. Your continued use of Virginia after changes are posted constitutes your acceptance of the revised Terms.
